Before the sale of a property—as well as in cases of gifts and property divisions—it is essential to verify whether the actual condition of the property matches the cadastral records; this correspondence must be confirmed both in the map’s cartographic representation and in the cadastral plan on file. Furthermore, to avoid the notarial deed being deemed null and void, this conformity must be specifically declared by the seller within the deed, with the cadastral floor plan attached. The firm performs standard cadastral, archival, and real estate registry research, as well as mapping new buildings and updating cadastral floor plans.

LAND REGISTRY OPERATIONS

There are many cases where a property complies with urban planning and building regulations, but its current condition has never been reported to the Building Registry, resulting in a non-existent or non-compliant cadastral floor plan. In such cases, a cadastral update may be carried out, which must be prepared by a licensed professional. Please note that failure to update the records will result in a penalty if the update is made more than one month after the completion of the work and up to five years thereafter. If the work performed did not involve any expansion beyond the original floor plan, it will be sufficient to file the updated floor plan with the Building Registry, accompanied by the DoCfa change form. If, however, the work carried out also involved an expansion of the building’s original floor plan, it is essential to record this change on the Land Registry map by filing the “Cadastral Map Type” document—prepared following on-site surveying to determine the new building outline—before submitting the new floor plan. If, however, the urban planning review reveals that work was carried out without the necessary planning permission or in violation of it, the situation becomes more complicated, and a solution must be sought on a case-by-case basis.

UPDATE ON THE CORTINA "TAVOLARE REGISTRY"

If the property being sold is located within the jurisdiction of a municipality where the Land Registry system is also in effect (Cortina d’Ampezzo, Colle Santa Lucia, etc.), any changes to the internal layout or external dimensions of the property must also be reported to the relevant Land Registry office, following specific procedures.

CHECK OF URBAN PLANNING AND BUILDING STATUS

Every property has “urban planning legitimacy” as evidenced by a building permit, construction authorization, or building approval. It is important that the actual condition of the property conform to the most recent building plan filed with the municipality.

 

Otherwise, the non-compliant parts are considered unauthorized or irregular and must therefore be rectified, otherwise the property cannot be sold. Unauthorized work also includes simple changes to the layout of rooms within an apartment and/or the construction of a new bathroom.

 

Unfortunately, this situation can also affect those who did not directly carry out the unauthorized work but have inherited a property that does not comply with urban planning regulations. In these cases, which are evaluated on a case-by-case basis, our firm intervenes by outlining the possibilities and costs of a regularization process and assessing its feasibility in relation to the cost of restoring the work to compliance.
